Terms of Sale and Return
The online store karloova.ee (hereinafter referred to as the "Online Store") is owned by Päikesekuu OÜ (registry code 14145216), located at L. Tolstoi 12-3, 50106 Tartu, Estonia.
Validity of the Sales Agreement, Product, and Price Information
These sales terms apply when purchasing products from the Online Store.
The prices of products sold in the Online Store are indicated alongside the products. The prices are in euros and include the value-added tax applicable in Estonia. A fee for the delivery of goods is added to the price.
The delivery fee depends on the buyer's location and the delivery method. The delivery fee is displayed to the buyer during the order placement process.
Information about the goods is provided directly next to the goods in the Online Store.
Placing an Order
To order a product, add the desired products to your shopping cart. To complete the order, fill in the required information fields and select the appropriate delivery method. The total fee will then be displayed, which can be securely paid via the following payment methods:
- Estonian bank payments
- Finnish bank payments
- Visa/Mastercard card payments
- Apple Pay and Google Pay
- Pay later solutions
Note: When paying via bank link, be sure to click the "Return to merchant" button on the bank's page.
Payments are mediated by Maksekeskus AS and Stripe Inc. Payments made via bank link occur outside the Online Store in a secure environment – when paying via bank link, in the secure environment of the respective bank, and when paying by credit card, in the secure environment of Stripe Inc. The seller does not have access to the customer's bank and credit card details. The agreement comes into effect upon the receipt of the payable amount into the Online Store's bank account.
The owner of the Online Store is the controller of personal data and forwards the necessary personal data for payment processing to the authorized processors Maksekeskus AS and Stripe Inc.
If the ordered goods cannot be delivered due to the goods being out of stock or for any other reason, the buyer will be informed at the earliest opportunity, and the paid money (including delivery costs) will be refunded promptly, but no later than within 14 days of sending the notification.
Delivery
Goods are shipped to the following countries: EU member states.
The buyer has the following options for receiving the goods:
- Smartpost parcel terminals in Estonia and Finland (Itella Estonia OÜ)
- Omniva parcel termnial in Estonia, Latvia, Lithuani and Finland
- Pickup from Päikesekuu OÜ warehouse – at L. Tolstoi 12-3, Tartu.
- International shipping within European countries.
The shipping costs are borne by the buyer, and the relevant price information is displayed next to the shipping method.
Domestic shipments within Estonia generally reach the destination specified by the buyer within 2-3 working days from the entry into force of the sales agreement. If the products include the addition of the baby's name, the delivery time is 5 working days. Delivery outside of Estonia takes place within 10 calendar days.
Exceptional cases are agreed upon between the client and the Online Store.
Right of Withdrawal
After receiving the order, the buyer has the right to withdraw from the contract concluded in the e-store within 14 days. This applies unless the product is customized with the baby's name.
To exercise the 14-day return right, the ordered goods must not be used in any other way than necessary to ascertain the nature, characteristics, and functioning of the goods in the same manner as allowed for testing the goods in a physical store.
If the goods have been used for purposes other than necessary to ascertain their nature, characteristics, and functioning, or if they show signs of use or wear, the Online Store has the right to refuse to accept the returned goods and to refund the money.
To return the goods, contact the Online Store at info@karloova.ee no later than 14 days after receiving the goods.
The costs of returning the goods are borne by the buyer, except in cases where the reason for the return is that the returned product does not correspond to what was ordered (e.g., wrong or defective product).
The buyer must return the goods within 14 days of submitting the withdrawal request or provide proof that they have handed over the goods to the carrier within this period.
Upon receiving the returned goods, the Online Store will promptly, but no later than 14 days from receiving the withdrawal request, refund all fees received from the buyer under the contract.
The Online Store may withhold the refund until it has received the goods that are the subject of the contract back or until the buyer has provided proof that they have sent the goods back, whichever occurs first.
If the buyer has explicitly chosen a delivery method other than the least expensive standard delivery method offered by the Online Store, the Online Store is not required to refund the cost that exceeds the cost of the standard delivery method.
The Online Store has the right to withdraw from the sales transaction and demand the return of the goods from the buyer if the price of the goods in the Online Store has been mistakenly marked significantly below the market price of the goods.
Right to Submit a Complaint
The Online Store is responsible for the non-conformity or defect of the goods sold to the buyer that existed at the time of delivery and that becomes apparent within one month from the date of delivery to the buyer.
The buyer has the right to contact the Online Store within one month of the occurrence of a defect by sending an email to info@karloova.ee or by calling +372 5256701.
The Online Store is not responsible for defects that have occurred after the delivery of the goods to the buyer.
If goods purchased from the Online Store have defects for which the Online Store is responsible, the Online Store will repair or replace the defective goods. If the goods cannot be repaired or replaced, the Online Store will refund the buyer all fees incurred under the sales contract.
The Online Store responds to consumer complaints in writing or in a form that can be reproduced in writing within 15 days.
Direct Marketing and Processing of Personal Data
The Online Store uses the personal data entered by the buyer only for processing the order and sending the goods to the buyer. The Online Store transmits personal data to companies providing transport services to deliver the goods.
The Online Store sends newsletters and offers to the buyer's email address only if the buyer has expressed a wish to receive them by entering their email address on the website and indicating their desire to receive direct mail notifications.
The buyer can unsubscribe from offers and newsletters sent to their email at any time by notifying us via email or by following the instructions provided in the email containing the offers.
Dispute Resolution
If the buyer has any complaints regarding the Online Store, they should be sent via email to info@karloova.ee or by calling +372 5256701.
If the buyer and the Online Store are unable to resolve the dispute by agreement, the buyer can contact the Consumer Disputes Committee. The procedural conditions can be reviewed and an application can be submitted here. The Consumer Disputes Committee is competent to resolve disputes arising from a contract between the buyer and the Online Store. The review of the buyer's complaint by the committee is free of charge.
The buyer may also turn to the European Union's online dispute resolution platform.
